Court of Protection

Court of Protection

When someone you care about loses the ability to look after their affairs, we are able to offer you the support both you and they require. If they are unable to enter into a Power of Attorney it may well be that you will have to apply to the Court of Protection in order to have the legal authority to assist them with their affairs. In cases like these, a Deputy may need to be appointed to be responsible for issues like property, finance and their health and welfare. A Deputy is often a close family member or friend or it may be a professional. Applications to be appointed as a Deputy are made to the Court of Protection.

Our team are able to assist clients with Deputyship applications and the ongoing responsibilities to both the patient and the Court of Protection. We have a specialist team who provide a comprehensive service to those whose financial and personal affairs need to be overseen by the Court of Protection. We can help you with:

  • submit the initial applications
  • submitting your annual report to the Office of the Public Guardian
  • completing tax returns
  • advice in respect of paying for care
  • making decisions
  • applying to the Court of Protection to make a Statutory Will

As professional Deputies for a number of clients, we appreciate that Deputyship appointments can be complex and need to be reviewed regularly. We can help you with those reviews, help make additional applications to the Court of Protection as necessary and ensure that our straightforward legal advice will keep this often confusing and upsetting process as stress-free as possible.

We regularly receive referrals from other Solicitors and Local Authorities to represent clients and have a strong reputation in this field. Gotelee’s breadth of experience enables us to deal with all aspects of a patient’s care whether that is from personal injury claim to deputyship application, from the purchase of a purpose built property to comprehensive planning of tax, financial and trust matters. We can see you at any of our offices in Ipswich, FelixstoweHadleigh and Woodbridge
